Welcome to FantomAero. These Terms of Service ("Terms") govern your access to and use of our website, products, and services, including the reservation, purchase, and operation of Fantom X eVTOL aircraft. By accessing our services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you may not access or use our services.

2. Aircraft Reservations & Pre-Orders

2.1 Pre-Order Process

• Customers may place a Pre-Order by submitting the required deposit through our website
• Pre-Order positions are assigned on a first-come, first-served basis
• Deposit amounts and payment schedules are outlined during the reservation process
• Pre-Orders do not constitute a binding purchase agreement until Final Payment is received

2.2 Deposit Terms

• Deposits are non-refundable unless otherwise stated in our Cancellation Policy
• Deposits are applied toward the final purchase price of the Aircraft
• FantomAero reserves the right to modify deposit requirements with 30 days notice
• Customers who fail to complete Final Payment may forfeit their deposit and Pre-Order position

2.3 Delivery Timeline

• Delivery Dates are estimates and subject to change based on production schedules, regulatory approvals, and other factors
• FantomAero will provide periodic updates on production and delivery timelines
• Delays in delivery do not constitute grounds for deposit refunds
• Customers will be notified 90 days before their expected Delivery Date

3. Pricing & Payment Terms

3.1 Pricing

• All prices are listed in USD and are subject to change without notice
• Price adjustments may occur due to changes in manufacturing costs, regulatory requirements, or technology improvements
• Customers with existing Pre-Orders will be honored at their original quoted price, subject to any modifications agreed upon
• Additional options, customizations, or upgrades will incur additional costs

3.2 Payment Methods

• We accept major credit cards, bank transfers, cryptocurrency (USDT), and financing options
• Final Payment must be received before Aircraft delivery
• Payment processing fees may apply depending on the payment method selected
• All payments are processed securely through our payment partners

3.3 Taxes & Fees

• Prices do not include applicable sales taxes, VAT, import duties, or registration fees
• Customers are responsible for all taxes and fees required in their jurisdiction
• FantomAero will provide estimates of additional costs when available

4. Aircraft Delivery & Acceptance

4.1 Delivery Locations

• Aircraft may be picked up at authorized FantomAero delivery centers
• Home delivery options may be available for an additional fee
• International deliveries subject to export regulations and shipping costs

4.2 Pre-Delivery Inspection

• Customers will have the opportunity to inspect the Aircraft before taking delivery
• Any discrepancies or concerns must be reported during the inspection period
• Acceptance of delivery constitutes acknowledgment that the Aircraft meets specifications

4.3 Customer Responsibilities

• Customers must hold valid pilot certification for eVTOL aircraft operation
• Customers are responsible for registering the Aircraft with relevant aviation authorities
• Customers must maintain required insurance coverage
• Customers must complete mandatory training programs before first flight

5. Aviation-Specific Terms

5.1 Regulatory Compliance

• All Aircraft are designed to comply with FAA Part 103 ultralight regulations
• Customers must comply with all local, state, and federal aviation regulations
• Aircraft operation is subject to airspace restrictions and weather conditions
• FantomAero will provide documentation for Part 103 compliance verification
• No pilot license, medical certificate, or aircraft registration required under Part 103

5.2 Pilot Requirements

• No pilot license required for operation under FAA Part 103 regulations
• Operators must understand and comply with Part 103 operational limitations
• FantomAero offers comprehensive training programs through certified flight instructors (strongly recommended but not mandatory)
• Training covers aircraft systems, weather assessment, emergency procedures, and regulatory compliance
• Customers are responsible for understanding FAA Part 103 restrictions and operational requirements

5.3 Insurance Requirements

• Customers must maintain aviation liability insurance with minimum coverage amounts
• FantomAero can provide recommendations for ultralight aviation insurance providers
• Proof of insurance may be required before Aircraft delivery

6. Warranty & Maintenance

6.1 Limited Warranty

• FantomAero provides a limited warranty covering manufacturing defects for 3 years or 500 flight hours
• Battery systems are covered by a separate 5-year warranty
• Warranty does not cover normal wear and tear, misuse, or improper maintenance
• Complete warranty terms are provided with Aircraft documentation

6.2 Maintenance Requirements

• Customers must follow the manufacturer's maintenance schedule
• Annual inspections by authorized service centers are required
• Failure to maintain the Aircraft may void warranty coverage
• Maintenance logs must be kept for all service performed

6.3 Software Updates

• Aircraft software will receive over-the-air updates for improvements and bug fixes
• Critical safety updates are mandatory and provided at no cost
• Optional feature upgrades may be available for purchase

7. Cancellation & Refund Policy

7.1 Customer Cancellation

• Customers may cancel their Pre-Order with 90 days written notice before scheduled delivery
• Cancellations within 90 days of delivery may forfeit the deposit
• Refund processing may take 30-60 business days
• Customization fees and non-standard options are non-refundable

7.2 FantomAero Cancellation

• FantomAero reserves the right to cancel orders due to production issues, regulatory changes, or force majeure events
• In case of FantomAero cancellation, full deposit refunds will be provided
• FantomAero is not liable for indirect or consequential damages resulting from cancellation

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@fantomaero.com to attempt to resolve the dispute informally. We will work with you in good faith to resolve any issues.

11.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. Arbitration will be conducted in the jurisdiction where FantomAero's principal office is located.

11.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Federal aviation regulations (FARs) and international aviation standards shall apply where applicable.
